The Company operates consistently with the Australian Privacy Principles contained in the Privacy Act 1988 (Commonwealth of Australia) (the Privacy Act) in the way that it handles personal information about the persons with and for whom it contracts and other individuals. This Privacy Policy explains how the Company handles your personal information consistently with the Privacy Act.
COLLECTION. The Company may collect personal information about you either directly, or through an entity with whom it engages in accordance with your consent, for the purpose of delivering the services provided by the Company as described in its Quality Management System. The Company’s services include: interpretation and drafting (includes instrument review and amendment); workplace investigations; risk management; industrial advocacy; and enterprise agreements. You may request a copy of the Company’s Quality Management System by contacting the Company as detailed under Further Information below. The Company also collects your personal information to enable it, and the entities with whom it engages in accordance with your consent, to provide you with information that is relevant to the services it provides and your area of interest. The types of information that may be collected by the Company for the purposes described above include: your name; your contact details; your standing in relation to an industrial, workplace or compliance matter; and other information or opinion about you, whether true or not, that is relevant to the service delivered by the Company.
USE and DISCLOSURE. Personal information about you which is collected by the Company will not be used or disclosed other than in accordance with the purpose of collection (as described under Collection above) unless you consent to that further use or disclosure of your information or it is otherwise permitted by the Privacy Act. The Company may use and disclose personal information for the purposes of discharging its services as set out in its Quality Management System. Entities to which the Company would usually disclose your personal information include: those with whom it engages in accordance with your consent; and the Company’s officers as necessary. If the Company provides service to you, it may bill you for provision, and for that purpose disclose your billing details to its overseas invoicers: SendOwl, holder of privacy policy accessible at https://www.sendowl.com/privacy ; PayPal Australia Pty Ltd, holder of an Australian Financial Services Licence and of privacy policy accessible at https://www.paypal.com/au/legalhub/privacy-full ; and Calendly, holder of privacy policy accessible at https://calendly.com/legal/privacy-notice . If you are a person authorised to represent an entity with whom the Company has contracted, your contact information may be provided in the Company’s confidential responses to requests for tender. If you are a person the Company has represented in relation to a public decision of a tribunal, your name may be published on the Company’s website or in other Company publications. From time to time, the Company or an entity with whom it engages in accordance with your consent, may distribute marketing and related communications for the purpose of informing you of matters relevant to the services it provides and your area of interest. If you do not wish to receive any marketing communications from the Company, you should contact the Company as detailed under Further Information below.
DATA QUALITY. The Company will make all reasonable efforts to ensure that the personal information it collects and uses and discloses is accurate and complete and up to date.
DATA SECURITY. The Company has appropriate security measures in place to protect personal information from misuse, interference or loss and from unauthorised access, modification or disclosure.
OPENNESS. You may obtain a copy of this Privacy Policy by contacting the Company as detailed under Further Information below. The Company retains and destroys your personal information in keeping with the Australian Solicitors Conduct Rules, including with regard to possession of documents.
ACCESS and CORRECTION. You may request access to your personal information held by the Company by contacting the company as detailed under Further Information below. The Company may decline to provide you with access to your personal information where it is permitted to do so under the Privacy Act. The Company may impose a charge for providing you with access to your personal information. You will be notified of any such charge at the time of making a request for access to your personal information. If you notify the Company that personal information it holds is not accurate, complete or up to date, then the Company will take action to correct the information.
